Did You Know? In order to work in the United States, you must apply for the required visa type that allows your temporary employment. You cannot seek employment while on a visitor visa such as a B1/B2 or Electronic System for Travel Authorization (ESTA) under the Visa Waiver Program.

Overview


First, it is important to understand that to work in the United States on a temporary basis, you must apply for the required visa. Foreign nationals cannot enter the United States as visitors with the intention to work in the United States, whether that is on a B1/B2 tourist visa or the Visa Waiver Program. If immigration suspects that you are working without authorization on a visitor visa, you may be barred from re-entering in the future.

Due to the serious consequences that can result from unauthorized employment, it is important to understand which visa types will allow you to work in the United States.

Many nonimmigrant visas allow you to work in the United States for a long duration. One such visa is the H-1B visa program for individuals who will work in a specialty occupation. If selected in the annual lottery, the H-1B visa is valid for 3 years and can be renewed one additional time for a total work period of 6 years. Thereafter H-1B visa applicants can apply for permanent residence based on employment-sponsorship.

Overview: 

The top visas used by Hotels and Restaurants to bring foreign workers to the United States are the J-1, H-3, H-2B, L-1, E-2, TN, and H-1B visas.  Whether transferring employees between international properties or employing management trainees, immigration is an integral part of the hospitality industry. The appropriate visa type will largely depend upon the foreign worker’s qualifications and the type of position the worker will be occupying.

The J-1 visa

The J-1 visa is a cultural exchange program between the United States and foreign countries bringing foreign workers to the United States. There are 2 types of J-1 visas. The first category is a trainee J-1 visa. To qualify the trainee must have at least 5 years of experience working in the position or a Bachelor’s degree or equivalent, with at least 1 year of experience. Workers who come to the United States on a J-1 trainee visa, may work in the United States for a hotel or restaurant for a period of 18 months. The J-1 trainee visa allows the foreign worker to develop their skills, gain experience, and return to their home countries taking those skills with them. The second category is for interns, who are in school in their home country or have recently graduated, and have less than 1 year of experience. Interns may come to the United States for a 1 year period to train in a hotel or restaurant. The work and travel category of the J-1 allows foreign workers to come to the United States for up to 4 months during the summer time. The J-1 visa is generally an easy visa to obtain. It takes approximately 6 weeks for this visa to get approved by the Department of State.

In this case study we describe a problem for a hospitality employer facing a need to hire seasonal workers.

The H-2B nonimmigrant visa program permits employers to hire foreign workers to come to the U.S. and perform temporary nonagricultural work, which may be one-time, seasonal, peak load or intermittent and there are no qualified and willing U.S. workers available for the job. Note that this visa is not available for “temporary” agencies or other work placement agencies.

There is a 66,000 per year limit on the number of foreign workers who may receive H-2B status during each USCIS fiscal year (October through September). The process for obtaining H-2B certification is similar to, but less extensive and time consuming, than permanent certification. You are eligible for the H-2B Visa provided that you have a valid job offer from a US employer to perform temporary or seasonal non-agricultural work and that you intend to return to your home country on expiration of the visa. For legal advice please visit us at www.h1b.biz
