Overview


As the spring and summer months are approaching, U.S. Embassies and Consulates worldwide are accelerating the processing of immigrant visas to reduce the visa backlogs.

As we have seen, the Department of State has advanced the Final Action Dates for most employment-based categories in the April Visa Bulletin. Additionally, significant advancements were also made in the March Visa Bulletin for the family-sponsored categories.

These advancements will keep the Department of State busy in the coming months, as more and more immigrant visa cases that are documentarily complete are scheduled for interviews at U.S. Embassies and Consulates worldwide for those with current priority dates.

As our readers will know, during the height of the Coronavirus outbreak, there was an enormous demand for visa interviews, but not enough interview slots for applicants to be scheduled. But now things are improving.

Adjustment of Status Filing Chart January 2024


As in the previous few months, the U.S. Citizenship and Immigration Services (USCIS) will continue to use the Dates for Filing chart in the month of January 2024 to determine eligibility for I-485 adjustment of status filings (green card filings inside the US).


 What Changes Can Be Seen Next Month?


Employment-based categories

  • EB-1 India: The EB-1 India Final Action Date will advance by three years and eight months, to September 1, 2020, and the Date for Filing will advance by a year and a half, to January 1, 2021.
  • EB-1 China: The EB-1 China Final Action Date will advance by four and a half months, to July 1, 2022, and the Date for Filing will advance five months, to January 1, 2023.
  • EB-2: The EB-2 Final Action Date for India will advance by two months, to March 1, 2012, and the EB-2 China Final Action Date will advance by approximately nine weeks, to January 1, 2020. Final Action Dates for the remaining countries in EB-2 will advance by three and a half months, to November 1, 2022.

Overview


What’s happening in the employment-based categories?

According to the Department of State’s February 2022 Visa Bulletin, the following final action cutoff dates will apply for the issuance of an immigrant visa for employment-based categories:

  • EB-1: All countries, including India and China, will remain current.
  • EB-2: India advanced by nearly 6 months to January 1, 2013, and China advanced by more than 5 weeks to March 1, 2019. All other countries will remain current.
  • EB-3 Professionals and Skilled Workers: EB-3 India and China will remain the same as the previous months at January 15, 2012 and March 22, 2018 respectively. All other countries will remain current.
  • EB-4 Certain Religious Workers: All countries, except El Salvador, Guatemala, Honduras, and Mexico, will remain current. El Salvador, Guatemala, Honduras remains at March 15, 2019, and Mexico remains at April 1, 2020
  • EB-5: The Non-Regional Center program will be current for all countries, including China. The Regional Center program has expired and is listed as unavailable in the February 2022 Visa Bulletin. If reauthorized, the Regional Center program will mirror the Non-Regional Center final action dates, except China, which would be subject to a November 22, 2015, final action date.

Which filing chart do I use if I want to apply for adjustment of status based on employment within the USA?


All employment-based preference categories, except EB-5 petitions based on the Regional Center Program, may apply for adjustment of status using the Dates for Filing chart in the Department of State Visa Bulletin for February 2022.


What’s happening in the family-sponsored categories?

En este video, el abogado Jacob Sapochnick explica el proceso para aplicar para la visa TN a base del Tratado de Libre Comercio de America del Norte, de Mexico, y Canada.

Que es la visa TN?

La clasificación no inmigrantes TN permite que los ciudadanos canadienses y mexicanos soliciten entrada temporal a los Estados Unidos para dedicarse a actividades comerciales a nivel profesional. El Tratado de Libre Comercio de América del Norte (NAFTA, por sus siglas en inglés) hace posible la entrada de estos profesionales.

Quien es elegible?

Entre los profesionales que son elegibles para admisión como No Inmigrantes T están los contables, ingenieros, abogados, farmacéuticos, científicos y maestros.  Usted puede ser elegible para obtener el estatus de no inmigrante NT si:

  • Es ciudadano de Canadá o México
  • Su profesión califica bajo la reglamentación
  • El puesto de trabajo en los Estados Unidos requiere un profesional NAFTA
  • Usted tiene un preacuerdo con un empleador estadounidense para un trabajo a tiempo completo o a tiempo parcial (no puede estar empleado por su cuenta – vea a continuación la documentación requerida), y
  • Tiene las calificaciones para practicar su profesión.

Cual es el periodo de estadia?

El periodo inicial de estadia es 3 años. Si usted desea permanecer mas tiempo de el período inicial de estadía sin salir del país, usted debe solicitar una extensión de estadía.

Proceso

Si usted es ciudadano mexicano, debe aplicar para la visa TN directamente en la Embajada o Consulado estadounidense en México.

Una vez se le haya aprobado la visa TN, deberá solicitar admisión en el puerto de entrada estadounidense designado o la estación de registro de pre despacho de aduana/ pre vuelo designada.
