In this post, we cover what the H-1B visa program is, why there is an annual cap on the number of H-1B visas available each year, and everything you need to know about the H-1B visa application process in 2023.


Overview


What is the H-1B Visa Program?

The H-1B visa is a nonimmigrant work visa that allows U.S. employers to hire foreign workers with specialized skills to work in the United States for a specific period of time. Generally, the job being offered by the U.S. employer must (1) require a bachelor’s degree or its equivalent (2) the degree should be common to the industry (3) and the duties required should be so specialized or complex that the knowledge required to perform them is usually associated with the attainment of a bachelor’s or its equivalent.

Professionals with job offers in the STEM fields (science, technology, engineering, and math) are the most common applicants for H-1B visas, although other fields may also qualify for the H-1B visa, such as finance, architecture, accounting, health, education, social sciences, physical sciences, medicine, among others.

Professionals who do not possess a bachelor’s degree or higher, but have at least 12 years of relevant experience, may still qualify for the H-1B visa without having a bachelor’s degree.

Once approved, an H-1B visa is valid for an initial period of 3 years and can be extended for an additional 3 years for a maximum period of 6 years in H-1B visa status. Thereafter, employers may sponsor workers for a green card.


Why is there a numerical cap on H-1B visas?


One of the drawbacks of the H-1B visa is that there is an annual numerical limit (cap) to the number of visas that can be issued each year. The annual cap for the H-1B visa program which has been set by Congress is 65,000 visas each fiscal year. An additional 20,000 petitions are set aside for beneficiaries with a master’s degree or higher from a U.S. institution of higher education.

H-1B workers who are petitioned for or employed at an institution of higher education or its affiliated or related nonprofit entities, a nonprofit research organization, or a government research organization, are not subject to the H-1B numerical cap.

In order to select enough petitions to meet the H-1B numerical cap of 85,000 visas per fiscal year, the United States Citizenship and Immigration Services (USCIS) conducts a visa lottery, selecting from properly submitted electronic registrations to fill the cap.

Historically, competition for the H-1B visa is very strong. As an example, in FY 2022 U.S. employers submitted roughly 308,613 H-1B registrations, and by 2023 this figure increased to 483,927 registrations.

Did you know? PERM Labor Certification is the process used for obtaining Labor Certification and is the first step for certain foreign nationals in obtaining an employment-based immigrant visa (Green Card). The employment-based preference categories that require PERM Labor Certification are EB-2 (other than a National Interest Waiver) and EB-3. Before a U.S. employer can file the I-140 Immigrant Petition for Alien Worker with USCIS, the employer must first obtain an approved Labor Certification from the Department of Labor (DOL).

The EB-3 comprises 3 sub-categories of foreign nationals: (1) skilled workers, whose jobs require a minimum of 2 years training or experience, and must meet the educational, training, or experience requirements of the job opportunity (2) professional workers whose job requires at least a U.S. baccalaureate or foreign equivalent degree and (3) other workers, performing unskilled labor requiring less than 2 years training or experience, not of a temporary or seasonal nature.

Overview


What is EB-3?


The EB-3 is an employment-based category for United States permanent residency. It is intended for “skilled workers,” “professionals,” and “other [unskilled] workers.”

Unlike persons with extraordinary abilities as in the EB-1 category, EB-3 applicants require a sponsoring U.S. employer to complete a labor certification process. There is no “self-petition” category under EB-3. You must have a permanent, full-time job offer from a U.S. employer and your employer must file a labor certification application on your behalf.

The EB-3 requirements are less stringent when compared to the EB-1 and EB-2 categories, typically reserved for individuals that can demonstrate extraordinary achievements (EB-1) or exceptional ability in a field that is in the national interest (EB-2).

Did You Know? The United States has a diplomatic presence in more than 190 countries around the world. During the COVID-19 pandemic, certain U.S. Embassies and Consulates have temporarily suspended certain U.S. visa services or have been operated at a very limited capacity due to local country conditions and regulations. In countries where the United States does not have a diplomatic presence, other U.S. Embassies or Consulates have been responsible for the processing of visas from those country nationals.

There is no U.S. Embassy or Consulate in my home country (or the post nearest me is closed) what can I do to get a U.S. visa? What are my options?

Options for Nonimmigrant and Immigrant Visa Applicants


In countries where the United States has no diplomatic presence, or where the U.S. diplomatic mission has limited or suspended its activities, often times the U.S. Department of States will accommodate visa seekers by processing their applications at U.S. Embassies or Consulates in nearby countries.

However, the U.S. Embassy or Consulate in a nearby country must be willing to accept applications from third-country nationals for the visa type sought. Please note that certain U.S. Embassies or Consulate may not be able to accommodate applicants if the officer is not trained to speak the third-country language or is not familiar with the process for third-country nationals. Third country nationals should also be aware that they bear the responsibility for paying their own costs of transportation and hotel stay in a nearby country, during the visa interview and visa issuance process. Medical examinations for immigrant visas may also need to be conducted by a civil surgeon in the nearby country, therefore applicants should contact the U.S. Embassy or Consulate where they wish to apply to understand the requirements and procedures for third-country nationals.

Due to the recent closure of the U.S. Embassy in Moscow, Russia, for instance, the Department of State designated U.S. Embassy Warsaw in Poland as the processing post for Russian immigrant visa applications.

Overview


First let’s start with some good news. In October of last year, the Biden administration took some major steps toward opening the United States to international travelers, lifting many of the COVID-19 related geographic travel bans that were put in place by the Trump administration to reduce the rapid spread of COVID-19. To provide relief to visa holders, President Biden later signed a Proclamation allowing fully vaccinated international travelers to enter the United States beginning November 8, 2021, regardless of their country of origin. At the same time the Proclamation, revoked the previous geographic travel bans including Proclamation 9984, Proclamation 9992, Proclamation 10143, and Proclamation 10199 for those fully vaccinated.

Unfortunately, U.S. Embassies and Consulates have been slow to adapt to the ongoing COVID-19 pandemic, with many posts still limiting operational capacity based on country conditions and local regulations. Services have not returned to pre-pandemic levels and there is simply no semblance of normalcy at the Consular level. This has been extremely frustrating for visa applicants who have been waiting in the massive visa backlogs for an interview.  According to Department of State statistics, approximately 90% of Consular posts continue to be subject to pandemic related restrictions with some partially open and others providing very limited services.

Because most Embassies and Consulates are not fully operational, many applicants currently in the United States that have filed and received approvals for work visa related petitions with USCIS such as H-1B, O-1, E-2 petition-related approvals, etc. have not been able to leave the United States to return to their home country for visa stamping. This has caused even greater frustration among applicants who are essentially “trapped” in the United States due to their inability to obtain an appointment for visa stamping. That is because applicants encounter greater risks when they choose to leave the United States, due to the uncertain and indefinite amount of time they could be waiting for a visa stamping appointment to become available while overseas. An even greater fear is the risk that the applicant may lose his or her job while waiting for an appointment that may not come for a very long time.

What are the major immigration provisions of the Build Back Better Act?


If passed section 60001 of the House bill would amend certain provisions of the Immigration and Nationality Act and open a path to permanent residency for four classes of immigrants allowing them to adjust their status to permanent residence (a green card). To be eligible, applicants would be required to pay a supplemental fee of $1,500, have no criminal background, and have no inadmissibility issues.

Under the bill, the following individuals would be eligible to apply for permanent residency:

  1. Dreamers: young undocumented immigrants brought to the United States as children before 2007, who have continuously resided in the United States, gone to school, and who otherwise have no criminal record
  2. Essential Workers: The Act would also extend an opportunity to individuals in our workforce who have played an essential role in our society, especially throughout the COVID-19 pandemic, such as health care workers, energy and transportation workers, public works employees, and manufacturing workers, among others.
  3. Temporary Protected Status recipients: recipients of Temporary Protected Status would also be eligible to apply for permanent residency. Temporary Protected Status is a temporary designation given to eligible nationals of designated countries affected by armed conflict or natural disaster. The TPS designation allows recipients to live and work in the United States on a lawful temporary basis
  4. Deferred Enforcement Departure applicants: those who have received a grant of Deferred Enforced Departure would also be eligible to apply for permanent residency. Deferred Enforced Departure (DED) (formerly Extended Voluntary Departure) is a form of relief from removal that allows certain individuals from designated countries and regions facing political or civic conflict or natural disaster to live and work in the United States on a lawful basis.

Overview


First, let’s discuss, what exactly is the National Interest Waiver?

The National Interest Waiver is part of the employment-based, second preference visa category for individuals who can demonstrate that they hold either an advanced degree or have exceptional ability in their proposed field or endeavor. Essentially, a National Interest Waiver allows an applicant to seek an exemption from the labor certification process, and bypass the job offer requirement typically required for individuals seeking an employment-based green card.  National Interest Waivers are granted to those who can demonstrate that their employment in the United States would greatly benefit the nation. The main advantage of the National Interest Waiver is that applicants can self-petition and do not need an employer to sponsor them. This is enormously beneficial when considering that the labor certification and recruitment process on its own can take a considerable amount of time to complete.

Furthermore, the 2016 ruling in Matter of Dhanasar introduced a brand-new framework for adjudicating National Interest Waiver petitions which broadened the pool of eligible applicants who could receive a National Interest Waiver.  Under the new standard, an NIW may be approved if it can be proved that (1) the foreign national’s proposed endeavor has both substantial merit and national importance; (2) the foreign national is well-positioned to advance the proposed endeavor; and (3) on balance, it would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification. The Dhanasar court clarified that to meet the third prong, the applicant must show that in light of the nature of the foreign national’s qualifications or proposed endeavor, it would be impractical either for the foreign national to secure a job offer or for the petitioner to obtain a labor certification.

Overview


As you know, on March 20, 2020, USCIS temporarily suspended premium processing services for all Form I-129 and I-140 petitions due to the Coronavirus. Petitioners who submitted a premium processing request in connection with Form I-129 or Form I-140, before the March 20 suspension, but received no action and no refund, may refile Form I-907 in keeping with the timeline discussed below.


How will premium processing services resume?


Premium processing will resume in a multi-phased approach.

First, effective June 1, 2020, USCIS will accept premium processing requests for all eligible Form I-140 petitions.

Second, effective June 8, 2020, USCIS will accept premium processing requests for:

  • H-1B petitions filed before June 8 that are pending adjudication and are cap-exempt (for example, petitions filed by petitioners that are cap-exempt and petitions filed for beneficiaries previously counted toward the numerical allocations).
  • All other Form I-129 petitions (non H-1B petitions) for nonimmigrant classifications eligible for premium processing filed before June 8 that are pending adjudication.

Overview:

As you know H-1B season FY 2021 is now in full swing. The new mandatory H-1B electronic registration system opened March 1, 2020 and will remain open until noon ET March 20, 2020.

Since the implementation of this new system our clients have been asking whether the system is working, whether there have been any glitches, and whether we have encountered any problems with the registration process.

So, what has happened since the system opened?

Unfortunately, during the first few days the system was open, our office encountered a few problems while registering our clients. The main problem was that the online system was locking us out and preventing us from completing our client’s registrations. Due to this, our office had to set up multiple accounts to prevent the system from locking us out in order to successfully complete the registrations.

Secondly, when registering in the system a code is supposed to be populated that is emailed to the employer for the purpose of verifying the information provided during the registration process. Our office experienced numerous problems retrieving this code, and in other cases the code provided by the system did not work altogether.

Welcome back to the Immigration Lawyer Blog, where we discuss all things immigration. In this video, we discuss whether you can file an application to extend your stay on a tourist visa if you have overstayed.

Disclaimer: We do not recommend overstaying your duration of stay on any visa classification, because serious immigration consequences could result. However, this post discusses the options you may have, if you find yourself in the precarious situation where you have already overstayed, and you have a good faith reason for having overstayed.

Overview:

Typically a person is given up to a 6-month period to remain in the United States on a tourist visa. At the end of those 6 months, the foreign national must depart the United States. The question is: are there any special circumstances in which a person may be allowed to extend their stay, where they have overstayed their visa?

In this case, the person stayed past the 6-month period of time allowed in the United States, and did not depart the United States. However, the person had a good faith reason for remaining in the United States. Toward the end of their stay, the individual had just given birth in the United States, and unfortunately some medical complications occurred that kept the individual in the United States past the 6-months authorized by their tourist visa. Because of these complications, the individual could not fly outside of the United States.
